These Terms and Conditions constitute a legally binding agreement between you and Caps Design LLC governing your access to and use of this website and any products purchased from it. By accessing the website or completing a purchase, you agree to be bound by these Terms in full.

All content, including product designs, engineering elements, graphics, branding, text, and intellectual property, is the exclusive property of Caps Design LLC and protected by United States law. Unauthorized copying, reproduction, modification, distribution, or reverse engineering is strictly prohibited.

All purchases are final. ALL SALES ARE FINAL. Caps Design LLC does not accept returns, exchanges, or refunds under any circumstances except where required by non-waivable law. By completing a purchase, you expressly acknowledge and agree to this policy.

Any attempt to initiate a chargeback, payment dispute, or reversal without lawful basis constitutes a material breach of these Terms. Caps Design LLC reserves the right to pursue recovery of disputed amounts, associated fees, collection costs, administrative expenses, and reasonable attorneys’ fees to the fullest extent permitted by law.

Shipping timelines are estimates only. Risk of loss transfers to the purchaser upon transfer of the product to the carrier. Caps Design LLC is not liable for carrier delays, customs issues, supply disruptions, weather events, or circumstances beyond its control.

CapsuLoader products are mechanical devices intended solely for organizing and filling empty capsules. Caps Design LLC does not manufacture, recommend, or endorse any ingestible substance. No medical advice is provided. Users are solely responsible for determining legality, safety, dosage, and suitability of any substance used in conjunction with CapsuLoader products. Caps Design LLC disclaims all liability arising from ingestion, formulation, handling, misuse, or improper use of substances.

Products are provided “as is” and without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose. Mechanical devices require proper handling. Caps Design LLC shall not be liable for damage, malfunction, or injury resulting from misuse, excessive force, modification, improper cleaning, commercial misuse, or failure to follow instructions.

To the fullest extent permitted by law, Caps Design LLC shall not be liable for indirect, incidental, consequential, punitive, or special damages. Total liability for any claim shall not exceed the purchase price paid for the product giving rise to the claim.

Neither party shall be liable for failure to perform due to events beyond reasonable control, including but not limited to natural disasters, governmental actions, supply chain disruptions, labor disputes, or carrier interruptions.

These Terms shall be governed exclusively by the laws of the State of Wisconsin, United States, without regard to conflict of law principles. Venue for any court proceeding not subject to arbitration shall lie exclusively in Milwaukee County, Wisconsin.

You waive any right to a jury trial.

BINDING ARBITRATION AND CLASS ACTION WAIVER

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to your use of the website, purchase or use of products, or these Terms shall be resolved exclusively through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall occur in Milwaukee County, Wisconsin, or by remote means where permitted.

The arbitrator shall have exclusive authority to determine enforceability of this arbitration agreement. The arbitrator may award relief only on an individual basis.

YOU AND CAPSU LOADER LLC WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

Claims must be brought solely in an individual capacity.

Before initiating arbitration, the complaining party must provide written notice and allow thirty (30) days for informal resolution.

If any portion of this section is deemed unenforceable, the remaining provisions shall remain in full force.

This arbitration provision survives termination of these Terms.
